TheBeats Inc. ("we," "our," or "us") recognizes the importance of data protection for our users ("you," or "your") and establishes this Privacy Policy to ensure the proper handling of your personal data in accordance with international laws including the GDPR, CCPA, and Japanese Act on the Protection of Personal Information.

1. Personal Data We Collect and Process

• Grade and school
• Location data (used solely to suggest your nearest school — never shared publicly)

Usage & Sharing (Optional)

• Phone contacts (optional — only if you choose to connect with classmates via contacts). When you grant contact access and consent, your contacts are securely uploaded to our servers solely to help you find friends on ttt. Contact data is encrypted in transit and at rest using AES-256-GCM encryption. We never share, sell, or use your contacts for any purpose other than friend discovery within the app.

App Activity

• Voice memos (processed by AI moderation before delivery, then deleted)
• Poll responses and voting history
• Coin earn/spend history
• Interaction data (polls answered, messages unlocked)

2. Purposes of Data Processing

• To provide, maintain, and improve our services and troubleshoot issues.
• To suggest your nearest school safely, ensuring only verified classmates can connect with you.
• To connect you anonymously with your classmates.
• To moderate voice content and ensure a 100% positive, safe environment.
• To generate your personalized monthly AI podcast.
• To comply with legal obligations and protect our legal rights.
• To respond to your inquiries and notify you about changes.

3. Legal Basis for Data Processing

We primarily process your data based on your consent to this Privacy Policy. You may withdraw consent at any time. We also process data for the performance of contracts, compliance with legal obligations, and our legitimate interests.

4. Secure Management of Personal Data

We use reasonable measures to protect information from loss, theft, misuse, unauthorized access, or destruction.

• Location data is used only to identify your nearest school and is never stored long-term or shared with other users.
• Phone contacts are encrypted on-device using AES-256-GCM before upload — we only store encrypted data and HMAC-SHA256 hashes on our servers. Your raw contact list is never readable by our team or any third party. Contact sync requires your explicit consent before any data is transmitted to our servers. Contact data is used solely for friend discovery within ttt and is never shared with third parties.
• Voice memos are deleted after AI moderation and delivery are complete.

5. AI-Powered Content Moderation

What Data Is Sent to AI

When you record a voice memo in ttt, the audio recording is sent to a third-party AI service for content moderation before it is delivered to the recipient. Only the audio data and the context of the poll question are sent — no personal identifiers such as your name, phone number, or contacts are transmitted to the AI service.

Which AI Service We Use

We use Google Gemini 2.0 Flash, operated by Google LLC, to analyze voice memo content for safety and appropriateness. Google's privacy policy applies to their processing of this data: https://policies.google.com/privacy.

User Consent

Before your first voice recording is sent for AI moderation, you will be asked to provide explicit consent within the app. You must agree to the AI moderation process before any voice data is transmitted to Google. You may choose not to consent, in which case you will not be able to send voice memos.

How Your Data Is Used and Protected

Voice memos are analyzed solely for the purpose of detecting harmful, inappropriate, or threatening content to maintain a safe environment for all users. The AI service evaluates the tone and content of each voice memo and returns a moderation decision (pass, block, or flag).

• Audio is transmitted securely using TLS encryption in transit.
• Audio is processed in real-time and is not retained by Google after moderation is complete.
• Google does not use voice memo data submitted through our API to train or improve its AI models.
• No personal identifiers (name, phone number, school, or contacts) are sent alongside the audio.
• Voice memos that are blocked by moderation are never delivered to the recipient.
• All voice memos are anonymized (pitch-shifted) on your device before being sent — your real voice is never transmitted.

6. Content Reporting, Blocking, and User Safety

ttt provides in-app tools to help users maintain a safe experience:

• Report Content: You can report any objectionable content directly within the app. Reported voice recordings are immediately restricted from playback on your account and flagged for review.
• Block Users: You can block any user to prevent their content from appearing on your account in the future.
• Trust & Safety Review: Our team reviews all reports and takes action within 24 hours, including content removal and permanent account suspension for users who violate our Terms of Service.
• Contact Us: You can reach our support team at any time at support@thebeats.app to report inappropriate activity or request assistance.

Report data (including the type of report, the content reported, and the reporter's account identifier) is stored securely and used solely for the purposes of content moderation and user safety enforcement.

7. Disclosure of Personal Data

We may disclose your personal data to:

• Our corporate entity, TheBeats Inc.
• Service providers monitoring performance and maintaining accounts.
• Counterparties in substantial business transactions (mergers, asset transfers).
• Law enforcement to comply with applicable regulations.

We will never sell your personal data to third parties for advertising purposes.

8. International Data Transfers

We may transfer your data to Japan and the United States. We implement necessary safety management measures including Standard Contractual Clauses (SCCs) to ensure equivalent protection levels.

9. Data Retention

We will not keep your personal data for longer than required for the purpose for which it has been processed. Retention periods are determined by data sensitivity and legal requirements.

• Voice memos are deleted after delivery and AI moderation processing is complete.
• Location data is not stored after school selection is complete.

10. Children

ttt is intended for users aged 13 and older. We do not knowingly collect data from users under thirteen (13) without parental consent. If such data is discovered, we will take immediate action to delete it.

11. Your Rights and Choices

You may request access to, correct, or delete your personal data. You also have the right to restrict processing or ask for data portability. Complaints can be lodged with your local supervisory authority.
